The Multi-District Litigation Panel ordered all TPC cases to be coordinated for pre-trial discovery before the Honorable Courtney Arkeen of the 128th Judicial District of Orange, Texas.
In lieu of a formal hearing in front of Judge Arkeen this month, the attorneys for Plaintiffs and the TPC attorneys held an informal settlement conference. Dean Brinkley, the Special Master appointed by the Court to oversee and facilitate settlement discussions between the parties, was in attendance. We provided the TPC attorneys and Mr. Brinkley the information regarding our claims to move settlement discussions forward. We are now waiting for the TPC attorneys to formally respond. The TPC attorneys indicated we would have a formal response within the next few weeks. We will keep clients updated as settlement discussions progress.
We have almost completed our investigation of potential claims against other parties who may have played a role in the TPC plant explosion. We expect to provide clients with specific information regarding our findings in the next few months.
Finally, we have started the process of scheduling depositions for the Corporate Representatives of TPC. The first deposition is scheduled for March 23, 2021. Additional depositions are scheduled for the days and weeks to follow.
The next status hearing will be conducted on April 5, 2021. The purpose of the conference is to receive updates on the progress of the litigation, resolve any pre-trial disputes, and keep the litigation moving toward completion. After the next hearing, we will publish another update on the litigation.
