TPC Explosion Litigation Client Update | February 2021

Earlier this year, the Multi-District Litigation Panel ordered all TPC cases to be coordinated for pre-trial discovery before the Honorable Courtney Arkeen of the 128th Judicial District of Orange, Texas.

Judge Arkeen conducted the most recent hearing on February 4, 2021. The primary issues addressed at the hearing included written discovery being answered by the parties, scheduling the depositions of the corporate representatives for TPC, obtaining documents from other potential defendants, and joining other defendants into the Litigation.

Judge Arkeen has appointed Special Master Dean Brinkley to serve as a liaison with the Court to oversee and facilitate settlement discussions between the parties. We are in the process of providing Mr. Brinkley with information about claims against TPC. Meetings with Mr. Brinkley and counsel for TPC are ongoing.

We have made significant progress in our investigation of potential claims against other parties who may have played a role in the TPC plant explosion. We expect to complete this investigation in the next few months.

The next status hearing will be conducted on March 1, 2021. The purpose of the conference is to receive updates on the progress of the litigation, resolve any pre-trial disputes, and keep the litigation moving toward completion. After the next hearing, we will update clients on the litigation.
