TPC Explosion Litigation Client Update | August 2021

The Multi-District Litigation Panel ordered all TPC cases to be coordinated for pre-trial discovery before the Honorable Courtney Arkeen of the 128th Judicial District of Orange, Texas.

Judge Arkeen held a formal hearing on Monday, August 9, 2021. The parties updated the Judge on the status of the litigation. The Plaintiffs previously added new Defendants to the litigation, including investors for TPC, Nalco, and Ingenero. Since that time, the Plaintiffs have identified additional investors for TPC that need to be added as Defendants, which are being added now. These investor Defendants are filing legal challenges to their being named as Defendants in the litigation. Those challenges will be heard and ruled on in the coming months. As a result, the parties do not have a final Scheduling Order for the litigation in place. There is no new information to share regarding TPC’s potential bankruptcy. Regardless of whether TPC files bankruptcy, and while we cannot guarantee the results, we are confident we will prevail in obtaining a recovery from TPC and the other defendants for the damages caused by the TPC Plant explosion. Discovery of the Defendants in the case is ongoing.

In the coming months, we will be reaching out to our clients to obtain additional information that the Defendants have requested and are entitled to receive. Our goal is to make the process of providing the Defendants additional information about your claim and as easy and efficient as possible.

The next status hearing will be conducted on September 13, 2021. After the next hearing, we will post another update of the litigation.
